“Victorious warriors win first and then go to war, while defeated warriors go to war first and then seek to win. ”– Sun Tzu (The Art of War, Chapter 4)

People find themselves in financial difficulty for a variety of reasons, most of which are out of their control: unexpected unemployment; equity loss; divorce; illness. If you are reading this, you are experiencing similar circumstances and need counsel from a focused, detail-oriented attorney who can see past those circumstances, assess your current situation, and provide objective advice about the options you do have to get you back to leading the life you want to live.

Jonathan A. Hagn, P.C., is a Federally-designated debt relief agency which helps individuals manage  their financial problems. The firm helps people file for bankruptcy under the United States Bankruptcy Code if bankruptcy is appropriate and, if it is not, help them explore and execute alternative resolutions, such as a debt settlement program. Most attorneys that offer bankruptcy representation do not offer – and may not even be keenly aware – of such alternatives.

Bankruptcy

Bankruptcy can be an effective and relatively inexpensive way of getting your debt under control quickly. Jonathan A. Hagn has counseled hundreds of individuals about whether bankruptcy is their best option and, if so, how and when to file a bankruptcy to maximize its benefits.

If bankruptcy is your best option, it is important to understand the types of bankruptcy and how they differ. Any bankruptcy filing, however, prohibits creditors from contacting you or taking any other action to collect debt from you, stops wage garnishment, can reverse garnishments of bank account and some other assets, and may delay or even completely halt foreclosure proceedings.

In most cases, a chapter 7 bankruptcy is the both the fastest and least expensive way to resolve your debt. In some cases, you may be required to surrender some assets to your creditors in order to receive a discharge of your debts. Jonathan A. Hagn can assist you in determining how best to protect your assets before filing a chapter 7 bankruptcy.

Generally, if your household income exceeds the median in the State of Colorado for your household size, you are presumptively ineligible to file a chapter 7 bankruptcy. Under those circumstances, Jonathan A. Hagn can help you determine whether a chapter 13 bankruptcy is your best alternative. In a chapter 13 bankruptcy, you are required to make payments to your creditors for three to five years, depending upon your income and other factors affecting your ability to make such payments. Jonathan A. Hagn can assist you in filing a chapter 13 bankruptcy that has the best chance for success under your particular circumstances.

Debt settlement

Bankruptcy is not for everyone. Even if you wish to file a bankruptcy, it may not be in your best interests to do so if, for example:

•    You have few assets and your only source(s) of income is protected by law from being taken away
      from you (e.g., social security, pension, or other retirement account payments);
•    You own substantial assets that you wish to keep but could not be protected in a chapter 7
      bankruptcy proceeding;
•    You have transferred any assets that could be recovered from the recipient in a chapter 7
      bankruptcy proceeding; and/or
•    You would be unable to make a monthly payment in a chapter 13 bankruptcy proceeding because
      your income is seasonal or otherwise inconsistent.
